5. Email Sending Requirements

All emails sent through our platform must comply with:

• Clear identification of the sender
• Accurate subject lines that reflect the email content
• Valid physical mailing address in the email
• Functional unsubscribe mechanism
• Prompt processing of unsubscribe requests (within 10 days)
• Permission-based email lists (recipients must have opted in)

6. Payment Terms

You agree to pay all fees associated with your selected plan:

• Fees are billed in advance on a monthly or annual basis
• All fees are non-refundable unless otherwise stated
• We reserve the right to change pricing with 30 days notice
• Overdue payments may result in service suspension
• You are responsible for any applicable taxes

7. Service Level Agreement

We strive to maintain 99.9% uptime for our services. However, we do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible. We are not liable for service interruptions due to circumstances beyond our control.

8. Intellectual Property

Our services, including software, designs, logos, and content, are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

You retain ownership of all content you upload or send through our services. By using our services, you grant us a limited license to process your content as necessary to provide the services.

9. Limitation of Liability

To the maximum extent permitted by law, MailingSolution.in shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of our services.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Termination

Either party may terminate the service agreement at any time with written notice. We reserve the right to suspend or terminate your account immediately if you violate these Terms. Upon termination:

• Your access to the services will be revoked
• Any outstanding fees become immediately due
• We may delete your data after 30 days unless legally required to retain it

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Indore, Madhya Pradesh.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website or notifying you via email. Your continued use of our services after such changes constitutes acceptance of the new Terms.
